PACA-ready invoices and grower settlements

Under the Perishable Agricultural Commodities Act, unpaid produce sellers keep priority trust rights only if terms and notices are right. Producepak prints the statutory trust wording on every invoice, keeps agreed terms on file and calculates grower settlements from the lots that were actually packed and sold.

PACA rules built into invoicing

  • Prompt payment is usually 10 days; other terms must be agreed in writing before the sale and cannot exceed 30 days to keep trust rights.
  • PACA licensees preserve the trust by printing the statutory wording on the invoice: "The perishable agricultural commodities listed on this invoice are sold subject to the statutory trust authorized by section 5(c) of the Perishable Agricultural Commodities Act, 1930 (7 U.S.C. 499e(c))..."
  • Otherwise a written notice of intent to preserve trust benefits is due within 30 days after payment was due.
  • Retailers need a PACA license once fresh and frozen produce purchases exceed US$230,000 a year; dealers handling more than 2,000 lb a day need one too.

Grower settlements from the packout

Every bin received is a lot. Packing runs record what each lot became – cartons by grade and size, culls and shrink – and sales record what each carton earned. Producepak turns that into grower statements by lot or pool, deducting packing, cooling, marketing commission and freight as agreed.

Questions

Is this legal advice?

No. The PACA points above summarize USDA AMS guidance; check your terms and invoice wording with USDA PACA or your attorney.

Can we change the trust wording?

The wording is stored as a template, so it can be updated if USDA guidance changes.
